1. Acknowledgment and Acceptance of Terms
By downloading or using Nutrifit AI, you agree to these terms, establishing a legal agreement directly between you and Nutrifit AI, not with any app store provider. You acknowledge that the app store provider is not responsible for the application and its content.
2. Scope of License
Nutrifit AI grants you a non-transferable license to use the app on devices that you own or control according to the app store’s usage rules. This license does not permit sharing over a network or on multiple devices simultaneously, except as allowed through family sharing or volume purchasing.
3. Usage Rules
You are prohibited from distributing, transferring, or sublicensing Nutrifit AI. Copying, reverse-engineering, creating derivative works of Nutrifit AI and its updates are forbidden, except where such restriction is prohibited by law.
4. Free Trial and Subscription
4.1 Free Trial: Nutrifit AI may offer a free trial period for access to premium features. The duration and specifics will be outlined within the app.
4.2 Subscriptions: Post-trial, a subscription is required for continued access to premium features, billed as specified in the app.
4.3 Auto-Renewal: Subscriptions auto-renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
4.4 Cancellation: Subscriptions can be canceled at any time via the app store settings, with access continuing until the end of the billing period.
5. Consent to Use of Data
Nutrifit AI may collect technical data to facilitate updates and services related to the app, using this information to improve its offerings.
6. Termination
This license is effective until terminated by you or Nutrifit AI, and will terminate automatically without notice if you fail to comply with any terms.
7. External Services
Nutrifit AI may enable access to third-party services and websites, which you agree to use at your sole risk, with Nutrifit AI having no liability for such external services.
8. Limitation of Liability and Health Disclaimer
8.1 NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF NUTRIFIT AI IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRIFIT AI AND ANY SERVICES PERFORMED OR PROVIDED BY THE APPLICATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. NUTRIFIT AI HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
8.2 Health Disclaimer: Nutrifit AI is not a medical device and does not provide medical advice. It is intended for wellness and fitness purposes only and not as a substitute for professional medical advice. 8.3 No Liability for Health Decisions: Nutrifit AI will not be held liable for any health-related outcomes based on the app’s use.
8.4 General Limitations: To the extent not prohibited by law, Nutrifit AI shall not be liable for personal injury, or any indirect, special, incidental, or consequential damages whatsoever, including, without limitation, damages for loss of profits, data, business interruption, or other commercial damages or losses, arising out of or related to your use or inability to use Nutrifit AI, regardless of the theory of liability (contract, tort, or otherwise) and even if Nutrifit AI has been advised of the possibility of such damages.
9. Legal Compliance
You represent and warrant that you are not located in a restricted country or on any government list of prohibited parties.
10. Governing Law
This agreement is governed by the laws of the jurisdiction in which you reside.
